Conditions

1. The Coaching Program materials you receive are confidential and proprietary, and cannot be used, disclosed or duplicated. These materials are unpublished works protected by copyright laws and no unauthorized copying, adaptation, distribution storage or displays are permitted.
2. All client personal details will remain strictly confidential with Keith Donald, and will not be shared with other parties without the written permission of the client. From time to time Keith Donald may introduce you to our other accredited health professionals, which may require joint liaison to ensure you receive the best care. In these instances you may of your own volition advise either party to share specific details.
3. Our services are advisory. You bear sole responsibility for the use and implementation of the coaching services. You agree to forever indemnify and hold harmless your Keith Donald from and against any loss, cost or expense resulting from your activities related to the subject matter in this document and in The Coaching.
4. While Keith Donald will be providing you with guidance, direction and program materials, such a role is advisory and not of actually doing the activity itself. You will be primarily accountable for producing the results in the program. In this way your Keith Donald seeks to educate you in order to make your successful health & fitness regime a life long activity.
5. Consultations can be re-scheduled, but often at the expense of desired times. If you need to reschedule meetings you agree to provide 24 hours notice or risk forfeiture of the consultation.
6. From time to time, your Keith Donald will be required to attend educational workshops and take a holiday and will need to schedule consultations around such times.
7. From time to time, we understand that you also will take a holiday or be away for work for extended periods. The minimum period of absence is two weeks to a maximum of eight, which will run as an extension to the term of the Agreement. A $10 admin fee will apply. A minimum of four weeks notice in writing is required. Regular payments will be placed on hold during the absence period, on the proviso the above notification criteria has been met. Whilst your coach will make all efforts to secure your regular coaching session time, it is not guaranteed that the session time will be available after the absence period. In this event the next available session time will be made available. Outside of holidays/work travel as per the above, the standard session conditions will apply.
8. You or Keith Donald may elect to terminate this agreement at any time upon thirty days notice in writing.
9. This agreement is the entire agreement between you and Keith Donald, all prior agreements, promises or representations being merged herein.
10. This agreement shall be governed by and construed and interpreted in accordance with the laws of the State of NSW.
11. If any law imposes a change in the nature of a goods, services, consumption, value added or similar tax which is to assessed or payable on any of the moneys which the Client must pay the Coach then this is payable by the client to the Coach when it is due for payment.
